WEST ELM TERMS AND CONDITIONS:
ELIGIBILITY: The Promotion is open to residents of the United Kingdom who are 18 or older at the time of entry. This Promotion promoted by Thejoyofplants.co.uk (Promoter) is not open to: (a) employees of the Promoter or West Elm (Supplier of the prize/Supplier) or its subsidiaries, associated companies, agents, and any other individual or entity connected with the development, judging, provision of prizes or administration of the promotion ("Promotion Entities") or (b) members of such employees' immediate families and persons living in the same household as such employees.
HOW TO ENTER: To enter, you must provide your email address and full name at time of entry via Thejoyofplants.co.uk competition entry form/page. No purchase is necessary to take part in this Promotion. One entry per person and per e-mail address. Any entrant found to be using any form of automating process to make bulk entries will be disqualified. All entries should be submitted in English. Entries that are not received, are received after the Closing Date, or which the Promoter deems inappropriate, illegible or otherwise noncompliant with these Terms will be deemed invalid and will not be counted. Proof of submission is not valid proof of the Promoter's receipt of an entry. Entries will not be acknowledged or returned.
PRIZES: There will be one (1) winner. The winner will receive a £250 gift card redeemable at the West Elm London store at 209 Tottenham Court Road W1T 7PN London, United Kingdom. Gift card subject to standard terms and conditions; see gift card for details. Should a winner wish to purchase product(s) above the value of the gift card, the winner will be required to pay the additional amount. There is no cash or other prize alternative available, except that in the event of circumstances outside of its control the Promoter or Supplier reserves the right to substitute a similar prize of equal or greater value. Prizes cannot be transferred to any other person.
WINNER SELECTION: The winners will be determined by random selection conducted by the Promoter from among all eligible entries on 27 October 2016. In the event a winning entry is discovered to be invalid for any reason whatsoever or the winner fails to comply with these Terms prior to delivery of the prize, the prize may be forfeited and awarded to an alternate winner.
NOTIFICATION OF WINNER: Winners will be contactedusing the e-mail address provided at entry. If an acknowledgement of notification is not received from a winner within fifteen (15) days of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, such winner will forfeit his or her prize and an alternate winner may be selected.
PROVISION OF THE PRIZE: The winners will receive their prize within four (4) weeks of selection and confirmation. Prizes will be sent to the UK postal address provided by the winners upon confirmation. The winners are responsible for any taxes that may apply to accepting prizes. The Promoter cannot accept responsibility for any damage to prizes caused during delivery.
DATA PROTECTION : By entering the Promotion, entrants agree to the Supplier's online privacy policy available at http://www.westelm.co.uk/WE-UK-Privacy-Policy, and agree that the Supplier may use their name, and contact information in accordance with the policy. Entrants have the right to access, rectify, complete, update and erase their personal information in accordance with the policy.
THEJOYOFPLANTS.CO.UK TERMS & CONDITIONS:
1, This free prize draw (“Promotion”) is open to all residents of UK aged 18 years or over. Proof of age may be required. Employees (or family members of employees) of any group company of the Promoter (Thejoyofplants.co.uk), Supplier (West Elm), companies associated with the Promotion and all affiliates of such companies may not enter this Promotion.
2, By participating in this Promotion you will be deemed to have accepted these terms and conditions and agreed to be bound by them.
3, Prize: A West Elm voucher to the value of £250 which will be delivered to an address in the UK specified by the winner as a reply to our email that you have won the prize. Prize voucher/gift cards will be delivered by West Elm. Prizes cannot be delivered to addresses outside the UK.
4, The Promotion starts on Wednesday 5 October 2016 and closes at 11.59pm UK time on Thursday 27 October 2016 (“Promotion Period”).
5, To take part in this Promotion visit www.thejoyofplants.co.uk during the Promotion Period. You ("Participant”) will need to answer the question to be entered into the competition.
6, The winners will be selected at random after the Promotion Period. The winners will receive an email and have to reply within 7 working days to receive the prize.
7, The Promoter does not accept responsibility for network, computer, hardware or software failures of any kind, which may restrict or delay the sending or receipt of your entry. Entries must not be sent in through agents or third parties. Incomplete entries, and entries which do not satisfy the requirements of these terms and conditions, will be disqualified and will not be entered.
8, If the Promoter has grounds to suspect any participant or third party of cheating, deception or fraudulent or unsportsman-like conduct of any kind (including, without limitation, manipulating the promotion, choice of successful participants or any entry) the Promoter reserves the right (in its sole discretion) to disqualify any participant, entry or person it reasonably believes to be responsible for, or associated with, such activity.
9, Winners will be notified by email no later than Friday 7 November 2916. The Supplier reserves the right to substitute the prize for a prize of equivalent or greater monetary value if this is necessary for reasons beyond its control.
10, There is no cash alternative to the prize and unless agreed otherwise in writing the prizes are non-refundable and non-transferable.
11,The Promoter and Supplier reserves the right to amend these terms and conditions at any time.
12, If any winner is not able, for any reason, to accept a prize, or cannot be contacted within 7 working days of the date winners are notified, the Promoter reserves the right to award the prize to another participant.
13, The Promoter’s decisions shall be final and binding in all respects on all participants. No correspondence will be entered into. Entries that do not comply in full with these terms and conditions will not be entered.
14, Except in the case of death or personal injury arising from its negligence, or in respect of fraud, and so far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from: any postponement or cancellation of the Promotion, and any changes to, supply of (including, without limitation, prizes which do not reach the intended recipient), or use of the prize, and any act or default of any third party supplier, which are beyond the Promoter’s reasonable control.
15, Details of successful participant’s names and county will be available for one month after the close of the Promotion by writing to the Promoter at the address set out below and stating the name and closing date of the Promotion.
16, Participants agree to allow the Promoter to use their name and likeness for advertising and publicity purposes without additional remuneration. The Promoter will use each participant’s, personal details for the purpose of administering this Promotion. 17, If you have opted in, the Promoter and Supplier may use the details you give us to contact you for marketing purposes by email and you can opt out at any time.
18, Please note that this Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. By participating, you acknowledge that Facebook bears no responsibility for this Promotion and, to the maximum extent permitted by law, you release Facebook from any liability whatsoever in connection with this Promotion. You understand that the information you provide is provided to the Promoter (and its affiliates, associates and agents where applicable) and not to Facebook.
19, This Promotion, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Promotion.
